Please see the InfoTrack Contracts page for the new General Terms and a summary of our contract model.
All Products that you order, access or use through your account on the InfoTrack Search Platform are covered by the General Terms as well as any relevant Product Terms and Third Party Terms.
Your use of the InfoTrack Search Platform and any applications within the platform are also covered by the General Terms.
This update will apply to your use of InfoTrack’s Products and your access to the InfoTrack platform, however you do not need to make any changes to your processes.
These changes have been made to refresh and enhance our General Terms, streamlining and clarifying our obligations while ensuring they remain transparent, fair and balanced.
InfoTrack is taking this opportunity to refresh our General Terms. The material changes are summarised below:
- Streamlined and refreshed: condensed, clearer, easier to navigate.
- Clause 6.5 (Beta Services): New clause enabling early access to beta products.
- Clause 14 (Indemnities): Clearer responsibility protections for both parties regarding claims arising from breach or misconduct
- Clause 15 (Limitation of Liability): Introduces a two-tier liability cap and clarifies exclusions for events outside our reasonable control.
- Clause 16 (Suspension of Access): Additional grounds on which InfoTrack may suspend access, including for security, legal/regulatory risk, or reputational concerns.
- Clause 18 (Consequences of Termination): Data retention rules simplified through revised ‘Retained Information’ provisions.
- Clause 19 (General Provisions): Reorganised force majeure provisions for easier navigation.
- Clause 20 (Confidentiality): Uplifted for compliance with securities exchange listing rules and IPO-related disclosures.
- Clause 21 (Privacy): Aligned data breach notification with regulatory standards.
- Clause 22 (Data Protection & Security): Security obligations now mutual, with security standards updated to ISO 27001:2022.
- Clause 23 (Client Data): Personal data processing requirements updated to include explicit legal basis requirements.
The new General Terms commence on 1 August 2026 for new Clients and 1 September 2026 for existing Clients. Until then, the current General Terms will remain in effect.
By continuing to use your InfoTrack account and ordering products from us on or after 1 September 2026, you are agreeing to the updated General Terms.
If you do not agree to our new General Terms, you may simply cease using your InfoTrack account at any time before they become effective on 1 September 2026 without the need to provide us with notice. Alternatively, you may elect to close your account before the new General Terms become effective.
You will be asked to accept the new General Terms when you first access your InfoTrack account.
Your MSA continues unchanged. The General Terms do not apply to you.
